An inquest jury has returned a verdict of unlawful killing on three people who died in an outbreak of Legionnaires' disease five years ago.

Legal Definitions:

  • Guidance issued by the Health & Safety Executive
    [HS(G)70]

    Following the guidance is not compulsory and you are free to take other action. But if you do follow the guidance you will normally be doing enough to comply with the law and may refer to this guidance as illustrating good practice.
  • Code of Practice approved by the Health & Safety Commission
    [L8 - 1995]

    An ACOP gives advice on how to comply with the law. The code has special legal status. If you are prosecuted for breach of health & safety law, and it is proved that you have not followed the relevant provisions of the Code, a court will find you at fault, unless you can show that you have complied with the law in some other way.
  • Approved Code of Practice & Guidance
    [L8 - revised 2001]

    This Code has been approved by the Health and Safety Commission with the consent of the Secretary of State. It gives practical advice on how to comply with the law in respect of thosespecific matters on which the code gives advice. You may use alternative methods to those set out in the Code in order to comply with the law.
    However, the Code has special legal status. If you are prosecuted for breach of health & safety law, and it is proved that you did not follow the relevant provisions of the Code, you will need to show that you have complied with the law in some other way or a Court will find you at fault

  • 1995: Approved Code of Practice - L8 - The prevention or control of legionellosis (including legionnaires' disease)
  • 1998: Supplement to HS(G)70 -The control of legioellosis in hot and cold water systems
  • 2001: Approved Code of Practice & guidance - L8 (Revised) - Legionnaires' disease - The control of legionella bacteria in water systems
